TOXXLAB, LLC INFRARED SWEAT AND TOTAL-BODY COMPRESSION SESSION CONSENT, RELEASE, AND ARBITRATION AGREEMENT

1. INFORMED CONSENT

I voluntarily consent to participate in infrared sweat bed sessions provided by TOXXLAB, LLC, located at 409 S. Main St., Elkhart, Indiana, 46516. I understand the nature of these services and acknowledge that they may increase core body temperature, induce sweating, and stimulate circulation with potential benefits such as detoxification, temporary pain relief, and calorie burning.

I confirm that I am at least 18 years of age or have attached a signed parental/guardian consent form (see Section 8). I understand that these services are not intended to diagnose, treat, or cure any disease, nor are they a substitute for professional medical advice.

2. ACKNOWLEDGMENT OF RISKS

I understand the possible risks, including but not limited to:

Dehydration or heat exhaustion

Dizziness or fainting

Skin irritation or sensitivity

Cardiovascular strain

Aggravation of existing medical conditions

I acknowledge that I am solely responsible for monitoring my well-being and will discontinue use if discomfort occurs.

3. GENERAL HEALTH ACKNOWLEDGMENT

I affirm that I am solely responsible for determining whether I am in appropriate physical condition to participate in infrared sweat and total-body compression services. I understand that TOXXLAB, LLC does not provide medical advice, diagnosis, or treatment, and makes no representations or warranties regarding the safety or suitability of infrared sweat sessions or total-body sessions for individuals with medical conditions. Services such as Infrared Sweat and Total-Body Compression are fully non-invasive wellness sessions intended for general well-being and health supplementation only. Sessions like this are generally very relaxing and rejuvinating for most people. TOXXLAB, LLC is not a medical entity nor does TOXXLAB, LLC provide medical advice. Individuals with medical conditions, health concerns, or questions should consult with their doctor or physician before participating.

The Infrared Sweat Session and the Total-Body Compression services are not medical treatments and are not intented to diagnose, treat, or cure any physical or medical condition.

By signing this agreement, I acknowledge that I have either:

• Consulted with a licensed medical provider regarding my participation, -or-

• Chosen to willingly proceed with full awareness of any personal health risks.

I understand and agree that TOXXLAB, LLC shall not be held liable for any adverse effects or injuries, whether known or unknown, resulting from my participation, and that the decision to use these services is entirely at my own risk.

4. RELEASE OF LIABILITY

In consideration for the services rendered, I hereby release, waive, and hold harmless TOXXLAB, LLC, its owners, employees, agents, and affiliates from any and all claims, damages, liabilities, or expenses arising from or related to my participation, including but not limited to negligence.

5. INDEMNIFICATION

I agree to indemnify and defend TOXXLAB, LLC against any claims brought by third parties resulting from my actions or omissions during or after use of the services.

6. CANCELLATION & REFUND POLICY

Appointments must be canceled or rescheduled no less than 24 hours in advance. No-shows and late cancellations will be charged in full using the payment method on file at the time of booking. By signing below, I consent to this policy and authorize TOXXLAB, LLC to charge my card accordingly.

7. MEDIA RELEASE & CONSENT TO PHOTO/VIDEO USAGE

By entering the premises of TOXXLAB, LLC and/or receiving services, I understand and agree that photographs and live or recorded video/audio footage may be captured during my visit, including while I am receiving services.

I grant TOXXLAB, LLC, its representatives, agents, and assigns the irrevocable, worldwide, royalty-free right to use, reproduce, publish, and distribute my image, likeness, voice, and/or testimonial in promotional materials, advertisements, websites, social media platforms, or other commercial uses without further permission or compensation.

I understand that I will not be identified by full name unless I provide separate written consent to do so. I waive any right to inspect or approve the finished product or materials in which I appear.

If I wish to opt out of media usage, I understand I must submit a written request in advance of my appointment.

8. TOTAL-BODY COMPRESSION/INFRARED SWEAT CONSENT & RELEASE

I understand that Total-Body Compression is a non-invasive compression service that uses controlled pressure to gently inflate and deflate in wave-like rhythms all over the body. It is not a massage service.

I understand that Infrared Sweating is a non-invasive infrared service that uses uses infrared light-wave radiation and localized infrared heat to raise your core body temperature, promoting a deep, detoxifying sweat. The therapeutic effects of infrared sweating is caused by the electro magnetic radiation spectrum. This heat & light combo helps relax and initiate detoxification within the body on a cellular level, causing you to sweat deep from within, releasing stored toxins & fat cells.

I acknowledge that these services are not intended to diagnose, treat, or cure any medical condition and is not a substitute for medical treatment. I understand that I am responsible for consulting a licensed medical provider before receiving this treatment if I have any health concerns, especially the following:

Cardiovascular conditions (e.g. heart disease, high/low blood pressure)

Blood clots, thrombosis, or phlebitis

Cancer or undergoing chemotherapy/radiation

Infections or fevers

Recent surgeries or wounds

Pregnancy or breastfeeding

Severe varicose veins or skin conditions

TOXXLAB, LLC is not a medical entity nor does TOXXLAB, LLC provide medical advice. Individuals with medical conditions, health concerns, or questions should consult with their doctor or physician before participating.

9. BINDING ARBITRATION CLAUSE

Any dispute, claim, or controversy arising out of or related to this agreement or services provided shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association. Arbitration will be held in Elkhart County, Indiana. I waive the right to a court trial or class action suit.

10. GOVERNING LAW & SEVERABILITY

This agreement is governed by the laws of the State of Indiana. If any portion is found unenforceable, the remaining provisions shall remain valid and in effect.

By receiving these services provided by TOXXLAB, LLC, I confirm that I have no known contraindications or have been cleared by a medical professional. I understand that any discomfort, reaction, or medical consequence that may arise is solely my responsibility. I agree to release and hold harmless TOXXLAB, LLC and its staff from any and all liability, claims, or demands arising from or related to these services.
